What is a Binding Death Nomination?

A binding death nomination is often made at the same time as a will.

A binding death nomination requires the trustee of your superannuation fund to pay the proceeds of the fund in the manner that you direct. The Binding death nomination may expire in 3 years or less and must be renewed.

A binding death nomination is often made if there is a fear that someone may challenge the manner in which the super is to be paid.

It is also possible to make a nonbinding nomination which gives direction to the trustee if it may be unclear as to the best way to pay the superannuation upon your death.

Our fee to prepare a binding death nomination at the same time as a Will or an EPA is $190 per nomination. If the Binding Death Nomination is prepared separately from a Will or an EPA we charge $500 for up to two mirror nominations.
